We, as a society, seem to have an obsession with death and how we will end our lives. From illness, to suicide, to unexpected death, our last moments have more of a weighted meaning than the moments from the prime of our lives. This is likely why our society has such an obsession with the last words spoken before death. The death penalty has been a focal point of controversy for the last several decades, but it’s been a practice that’s been in existence for hundreds of years as being put to death was a customary punishment for even the simplest offences. Now, if you’re an inmate on death row, the date and time of the end of your life has already been determined. It can be either relaxing or unsettling to know when your death will be, but it can also provide an ample opportunity to prepare the perfect set of last words. If you knew you were going to die, what would be your last words? This video provides ten of the most shocking last words by inmates who were on death row. From quirky, to confusing, to profound, these inmates really shook the core of those around them enough to where people are still talking about their last words today. For example, Robert Towery was put to death in 2012 by lethal injection and said, “I love my family. Potato, potato, potato.” This is quite a confusing set of last words. The first sentence makes sense, but them the “potato” part not so much. Was his family named potato? Did he want to eat a potato? Regardless of the reason, it made numerous people raise an eyebrow to the statement. Perhaps weird last words such as this could even mean something to a long lost friend or relative out there, or the inmate just wanted to have one last hurrah, even if it was psychologically. Then we have death row inmates who can be humorous and sassy on their last day. For example, George Appel was sentenced to death after killing an NYPD officer. As he prepared to get into the electric chair, he said, “Well, gentlemen, you are about to see a baked Appel.” But he wasn’t the only one to make a joke out of his name. James D. French was initially sentenced to life in prison. Not wanting to commit suicide, he killed his cell mate so that he could be executed. His last words before being electrocuted were, “Here’s this for a headline? ‘French Fries’.” Finally, the impact of last words could quite have the potential to change the world or force people to rethink their morals and standards. Robert Drew was executed in 1994 and said, “Remember, the death penalty is murder.” For a murderer to say that, it seems as though he is leveling the playing field with the judicial system. As we continue to live our lives, perhaps the concept of last words should be more of a forethought instead of an afterthought. As strongly as I feel about any issue, I understand the opposition. But there is an exception: the death penalty for murder. Here, the gulf is unbridgeable between those of us who believe that some murderers – and I emphasize some murderers – should be put to death and those who believe that no murderer should ever be put to death. Take this example: On the afternoon of July 23, 2007, in the town of Cheshire, Connecticut, two men broke into the home of Dr. William Petit, his wife Jennifer and his two daughters. The men beat Dr. Petit nearly to death with a baseball bat; one of the men raped the doctor’s wife; and the other man sexually assaulted their 11 year-old daughter, Michaela. The two men then strangled Mrs. Petit to death, tied down the two daughters on beds, doused them with gasoline, and, while the girls were still alive, set the house on fire. Dr. Petit survived, but his wife and daughters did not. Those opposed to capital punishment believe that these two men have a right to keep their lives. So, is there anything a person can do to deserve the death penalty? To those opposed to capital punishment, the answer is no. In fact, many opponents of capital punishment believe that killing murderers is the same as murder. You heard me right – most opponents equate the murder of an innocent family with putting the murderers of that family to death. Opponents of capital punishment also argue that keeping all murderers alive sanctifies the value of human life. But the opposite is true. Keeping every murderer alive cheapens human life because it belittles murder. That’s easily proven. Imagine that the punishment for murder were the same as the punishment for driving over the speed limit. Wouldn’t that belittle murder and thereby cheapen human life? Of course, it would. Society teaches how bad an action is by the punishment it metes out. And what about the pain inflicted on the loved ones of those murdered? For most people, their suffering is immeasurably increased knowing that the person who murdered their family member or friend – and who, in many cases, inflicted unimaginable terror on that person – is alive and being cared for. Of course, putting the murderer to death doesn’t bring back their loved one, but it sure does provide some sense of justice. That’s why Dr. Petit, a physician whose life is devoted to saving lives, wants the murderers of his wife and daughters put to death. In his words, death "is really the only true just punishment for certain heinous and depraved murders." Is the doctor wrong? Is he immoral? Well, if you think capital punishment is immoral, then Dr. Petit is immoral. And what about opponents’ argument that an innocent person may be executed? This argument may be sincerely held, but it’s not honest. Why? Because opponents of capital punishment oppose the death penalty even when there is absolute proof of the murderer’s guilt. If there were a video of a man burning a family alive, opponents of capital punishment would still oppose taking that man’s life. It is interesting to see what these hardened criminals choose as their last moment of food consumption that they will ever have in their lives. What it must be like for these people to eat what they know as their last meal is the subject of books and movies. We can never directly relate to the experience except for what we can watch from a distance. You can a lot about a prisoner’s personality based on what they chose as their last meal. Some want to gorge on all of their favorite foods, while others want to recreate a favorite meal from their past like their wedding dinner or a home-cooked meal from their mother. But then there are other inmates who will be snarky and request things like “world peace” or a lump of dirt like James Edward Smith did (that request wasn’t obliged and he was given yogurt instead). And there are also inmates who will exercise their sweet tooth with ice cream, cakes, candy, and other variations of sweets. Or, you will have the inmates who will not even request a last meal and will sit in prayer and meditation as their execution comes closer with each tick of the clock. One of the most infamous murderers, John Wayne Gacy, who had raped and killed 33 boys and young men, had a meal that was clearly reminiscent of his life. He managed three KFC restaurants in his life, and requested a bucket of original recipe KFC chicken, 12 pieces of fried shrimp, French fries, and a pound of strawberries. The meal was both indulgent and enjoyable it seems before he died the next day. So what exactly have inmates requested for their last meals? Check out the video to find out. According to the theory of Privilege, everybody is born into different circumstances, and those circumstances make certain outcomes in life more likely relative to those born into different circumstances. Circumstances that render a higher likelihood of a fulfilling life are what's labeled 'Privileges.' The Argument: This is a theory, nevertheless, a fair observation. Certain characteristics make certain outcomes more likely. However, many of the characteristics labeled 'Privileges' are conditional and many of them can be earned (if not already inherited). This is an abstract argument and should not be used to justify an assumption about individuals. Sri Lanka to bring back death penalty for drug offenders and other stories in JUST ASIA, Episode 247

This week Just Asia begins with Sri Lanka, where President Maithripala Sirisena told parliament last week that he was ready to bring back the death penalty for drug offenders within one or two months. The last hanging in Sri Lanka took place in 1976, since when there has been a moratorium on capital punishment. President Sirisena visited the Philippines in January, and was inspired by President Rodrigo Dutertes’ ruthless tactics in dealing with drug dealers and criminals. Next, Burma’s Rakhine state is seeing yet another military crackdown, with soldiers shelling villages, blocking food supplies and detaining civilians. The recent crackdown began after an armed ethnic Rakhine group attacked four police posts on January 4, reportedly killing 13 officers. According to the UN, more than 5,200 people have been displaced by the subsequent fighting. Most of the displaced belong to Buddhist ethnic minorities. Moving to Indonesia, neither of the country’s two presidential candidates are talking human rights in their campaign. The first presidential debate organized by the National Election Commission on January 17 was meant to focus on human rights and law enforcement, but neither President Mr. Joko Widodo, running for his second term, nor Mr. Prabowo Subianto, representing the opposition, explained how they would address the many gross violations of human rights cases pending from the Suharto regime until the present. The debate was widely criticized by victims and family members of past human rights abuses. In the Philippines, the January 30 murder of peace activist Randy Malayo is the latest attack on human rights defenders in the country. Malayao worked with peasant groups in Cagayan Valley, pushing for the welfare of farmers and fisherfolk, and fighting against militarization in remote areas. According to data from human rights group Karapatan, there have been at least 134 defenders killed under the Duterte administration. Next, in India, there is jubilation in the country’s north-east region due to the lapse of the contentious Citizenship Amendment Bill. India’s north-east has been rocked with protests over the past few months due to the inherently flawed bill that proposed citizenship rights for persecuted minorities from the neighboring countries of Afghanistan, Bangladesh and Pakistan. The Bill flouted many articles of the Indian constitution including Article 15, prohibiting discrimination solely on the basis of religion. In Pakistan, Asia Bibi continues to remain in hiding after the country’s top court dismissed all petitions against her on January 29, and upheld her acquittal from blasphemy charges. Asia’s close friend and rights campaigner said she has been moved to a new “secure area” in Karachi. Aman Ullah added that she and her husband are locked in a single room in a house where the door opens only “at food times”. Although Asia has been offered asylum by Canada, where her two daughters already are, she is not being allowed to leave.

Wide shot of news conference STORYLINE: Iraq on Sunday reinstated its suspended capital punishment law for people guilty of murder, endangering national security and distributing drugs, the government announced. The announcement came a day after the government offered an amnesty to Iraqis who committed minor crimes after the fall of Saddam Hussein's regime last year. The two laws were part of a carrot-and-stick approach by the government to try to coax some insurgents to lay down their arms while beefing up its ability to punish those that refused. Capital punishment had been suspended during the U.S. occupation, which ended with a transfer of power to the interim government June 28. Under Saddam's regime, some 114 offences could garner the death penalty. The new law was more restrictive than the previous death penalty. Minister of State Adnan al-Janabi said the aim of the law was to create "stability and security." He added that the government will work "to end executions in the future once we have stability." In announcing the law, al-Janabi and Human Rights Minister Bakhtiar Amin said they regretted bringing back executions, but they were needed to fight the militants who they accuse of destabilising the country. It was unclear how the new death penalty law would effect Saddam, who is currently awaiting trial on war crimes charges. It was not clear whether the death penalty would apply to people who had committed crimes during its suspension. The law also did not specify how the executions were to be carried out, or if they were to be done in public or private. Kinds of solitary confinement differ all over the world, and no doubt in some countries you still have what might better be called dungeons. In most developed countries these days such segregation units are not as barbaric and prisoners should have some time outside of the cell as well as receive enough nourishment that they won’t be looking forward to the next time an insect gets into their cell. Nonetheless, many critics call it an inhumane, psychological torture that is hardly in line with rehabilitation. Sri Lanka to bring back death penalty for drug offenders and other stories in JUST ASIA, Episode 247

This week Just Asia begins with Sri Lanka, where President Maithripala Sirisena told parliament last week that he was ready to bring back the death penalty for drug offenders within one or two months. The last hanging in Sri Lanka took place in 1976, since when there has been a moratorium on capital punishment. President Sirisena visited the Philippines in January, and was inspired by President Rodrigo Dutertes’ ruthless tactics in dealing with drug dealers and criminals. Next, Burma’s Rakhine state is seeing yet another military crackdown, with soldiers shelling villages, blocking food supplies and detaining civilians. The recent crackdown began after an armed ethnic Rakhine group attacked four police posts on January 4, reportedly killing 13 officers. According to the UN, more than 5,200 people have been displaced by the subsequent fighting. Most of the displaced belong to Buddhist ethnic minorities. Moving to Indonesia, neither of the country’s two presidential candidates are talking human rights in their campaign. The first presidential debate organized by the National Election Commission on January 17 was meant to focus on human rights and law enforcement, but neither President Mr. Joko Widodo, running for his second term, nor Mr. Prabowo Subianto, representing the opposition, explained how they would address the many gross violations of human rights cases pending from the Suharto regime until the present. The debate was widely criticized by victims and family members of past human rights abuses. In the Philippines, the January 30 murder of peace activist Randy Malayo is the latest attack on human rights defenders in the country. Malayao worked with peasant groups in Cagayan Valley, pushing for the welfare of farmers and fisherfolk, and fighting against militarization in remote areas. According to data from human rights group Karapatan, there have been at least 134 defenders killed under the Duterte administration. Next, in India, there is jubilation in the country’s north-east region due to the lapse of the contentious Citizenship Amendment Bill. India’s north-east has been rocked with protests over the past few months due to the inherently flawed bill that proposed citizenship rights for persecuted minorities from the neighboring countries of Afghanistan, Bangladesh and Pakistan. The Bill flouted many articles of the Indian constitution including Article 15, prohibiting discrimination solely on the basis of religion. In Pakistan, Asia Bibi continues to remain in hiding after the country’s top court dismissed all petitions against her on January 29, and upheld her acquittal from blasphemy charges. Asia’s close friend and rights campaigner said she has been moved to a new “secure area” in Karachi. Aman Ullah added that she and her husband are locked in a single room in a house where the door opens only “at food times”. Although Asia has been offered asylum by Canada, where her two daughters already are, she is not being allowed to leave.

The takeover of the Department of Justice by Jeff Sessions has had an enormous impact on the politicizing of the criminal justice system ~ none more seriously than in policies affecting the death penalty. Russell Neufeld graduated from Brooklyn Law School in 1982. He spent the next 22 years at The Legal Aid Society. He created and led the Capital Division of The Legal Aid Society from 1995 - 2002. He was co-counsel in New York State's first death penalty trial in the modem era and was co-counsel in the first full acquittal verdict in Kings County under the then new first degree murder statute. He was the Attorney-in-Charge of the Criminal Defense Division and Criminal Practice at the Legal Aid Society from 2002 - 2004.. He taught in the BLS criminal clinic and legal writing programs. Mr. Neufeld taught a course on the death penalty at New York Law School from 1996 - 2002. He has published numerous articles on capital punishment and human rights. While at The Legal Aid Society, he started and coordinated the Alabama Death Row Project which handled capital post-conviction cases. In2004 he went into private practice, initially associated with the firm of Cochran, Neufeld & Scheck. Since 2000 he has represented capital clients in federal district courts, the Second Circuit Court of Appeals and the U.S. Supreme Court.. He is a board member of Witness To Innocence- the national organization of death row exonerees.

His teaching and research interests include micro-social theories of criminal behavior, macro-social theories of crime and crime control, assessments of issues regarding the legitimacy of capital punishment, and quantitative data collection and analysis.
